“Ensuring the Delivery of Donated Goods to Survivors of Catastrophes” 

 

July 18, 2008 (WASHINGTON) – On Thursday, July 31th, the House Committee on Homeland Security Subcommittee on Emergency Communications, Preparedness and Response, chaired by Rep. Henry Cuellar (D-TX) will hold a joint hearing with the Senate Committee on Homeland Security and Governmental Affairs Ad Hoc Subcommittee on Disaster Recovery, chaired by Sen. Mary L. Landrieu (D-LA), entitled “Lessons Learned: Ensuring the Delivery of Donated Goods to Survivors of Catastrophes.” The hearing will examine how FEMA managed donated goods during Hurricane Katrina and what efforts FEMA has made to better streamline this system and ensure that states, local governments and non-profit organizations are properly coordinating in the wake of a catastrophe. Chairman Cuellar released the following statement on the issue:“It appears that FEMA improved its logistics operations regarding the delivery of donated goods during the most recent flooding in the Midwest.  Congress however, must continue to perform oversight to ensure that the appropriate survivors are receiving the necessary items they need to recuperate from an incident.”Senator Landrieu added the following statement:“FEMA has proven to be, time and again, deaf to the immediate needs on the ground in the aftermath and long-term recovery from a major disaster,” Senator Landrieu said. “I am hopeful that this joint hearing will shed the light of public scrutiny on FEMA’s broken communications chain. We want to ensure the government will never again misroute necessary supplies intended for disaster victims to other government agencies and states for their everyday business.

Ms. Cherri Branson, Chief Oversight Counsel for Homeland Security states she is African American, but appears to act as though she has an obligation to protect the discriminating practices of FEMA.

Landrieu was a participant. We have been denied the ability to testify as we are not allowed to testify on the FEMA investigation July 31, 2008

July 10, 2008 I sent an e-mail to Congressman Bennie Thompson’s office asking to participate in any upcoming Hearing regarding KATRINA. After attempting to reach the Congressman’s Legislation Assistant, Ms. Tsmith, I was later contacted by Ms. Branson.  Ms. Branson asked that I submit to her the written contract agreement with FEMA.  She also stated that I should submit a statement of “my” losses.  When asked the procedure after she receives these documents, Ms. Branson was somewhat non-responsive.

I will submit the contract agreement you requested.  I will also include the recorded conversations and documents to show that UAAD and others met their obligations to this contract in good faith.

 Mr. Ellis—I’m really sorry, but I do not understand your email.  What I do understand is that yesterday, you told me, and unequivocally that FEMA broke its contract with you.  The letter provided satisfactorily shows that there was no contract, and the attached agreement was not signed by FEMA.  Beyond that point, I truly don’t understand your grievance and I’m not sure how else we can help you on this matter.   I’m not involved with Ms. Branson’s activities and cannot speak for her or her office, but as for the Subcommittee on Disaster Recovery, there does not seem to be any reason to investigate further.

With regard to there being a racial component, I don’t understand d your charge.  If your charge is that FEMA won’t provide your organization trailers because your organization is an African American organization, you have provided absolutely NO evidence to back up that assertion.  Moreover, FEMA stated, rather clearly in my view, their reason for denying trailers for your organization in the January 19th letter, which again, stated: “FEMA has elected not to proceed with your organization at this time.”  The agency described your intention to charge non-profit organizations $3,000 per unit, with a $5,000 legal and administration fee as inconsistent with law and FEMA’s regulations, which is consistent with Page A-2 of the unsigned agreement for donated housing that you attached in your email which states, “Unite Affirmative Action Development Corp hereby agrees not to sell, transfer, donate, or otherwise dispose of the units for eighteen months from the date …”

 I have also reviewed the entire fax you sent, which did not, I should add, include the January 19,2007 letter, which I believe was extremely disingenuous.  I did not find in this pack of information, ANY evidence that FEMA did anything that would warrant this Subcommittee’s continued attention.  If there is some other documentation that would more clearly and thoroughly demonstrate your point, please forward it.  Otherwise, this will be my last email with regard to the subject.

I had a conversation with Ms. Cherri Branson this date July 25,2008 who stated she had received the contract I had signed with FEMA, and the supporting documents.  Ms. Branson indicated that I needed to provide her with an agreement that was signed by FEMA.  In several conversations with Ms. Branson I had told her that the contract was not signed by FEMA.  When asked if she was going to review the other documents, or speak to FEMA and others involved with the agreement, she indicated that she was not going to investigate any further.The present investigation apparently involves a signed agreement with some organization?  UAAD posses documents and proof that FEMA made a commitment to provide donated items to the KATRINA Victims, similar to these items being investigated.  Is there a reason that FEMA's fraud is different in the case of the donated goods and the trailers that were fully furnished?  Whether there was a contract signed or not signed do FEMA have an obligation to show where the trailers were disbursed, and why they were not allocated to other non-profits as we asked after refusing to donate them to UAAD an African American organization?

 Mr. Ellis—I am responding to you call claiming that the Federal Emergency Management Agency (FEMA) broke a contract that would have allowed your organization to provide trailers to disaster victims and your desire to testify on the matter.  I have contacted FEMA legislative affairs and the office forwarded me the attached document that was NOT included in the documents you furnished to this office.  Your claims to have been in a contract with FEMA are directly contradicted by the agency in this January 19, 2007 letter to you from the FEMA in which the agency clearly states that, “FEMA has elected not to proceed with your organization at this time.”  Further the agency described your intention to charge non-profit organizations $3,000 per unit, with a $5,000 legal and administration fee as inconsistent with law and FEMA’s regulations.  We will not be investigating this matter further.  If you have another issue of concern, please contact our office, but with regard to your claim that FEMA broke a contract with you, we will not take further action.  Thanks for contacting the Subcommittee on Disaster Recovery.  If there’s anything more we can help you with, please let us know.

FEMA used false accusations regarding not following through with the agreement with UAAD.  I again ask what did FEMA do to disperse the 10,000 surplus trailers and hundreds of module units that were specifically purchased by GSA for the KATRINA Victims.  Why were these victims, other than being African Americans denied these temporary housing units?  Why were these units not dispersed to these victims by other means if UAAD did not meet FEMA's standards?  Are you aware that FEMA broke the agreement after UAAD insisted that they donate new units as originally agreed, and broke the agreement after UAAD refused to accept used units?  This was the process that FEMA was using to distribute the small travel trailers.  FEMA according to Joathan.clark@dhs.gov  a FEMA employee at the Baton rouge, LA facility would disperse the larger handicap units to WHITES, while giving Blacks the rat infested and unhealthy units to BLACKS.  When you or CNN investigate these claims as they should with the information I have provided, I will than discontinue contacting your office.  If you look through the documents I sent you will find the attachment you sent. 
I again ask what happened to the mobile homes and module homes purchased by GSA, and why UAAD's associates were not provided temporary housing
